The Syntactic Structure in Forming Legal Sentences in the Saudi Civil Transactions Law

(An Analytical Study in Light of Arabic Grammatical Rules)

Abstract

This research, entitled “The Syntactic Structure in Forming Legal Sentences in the Saudi Civil Transactions Law: An Analytical Study in Light of Arabic Grammatical Rules,” addresses the main question: How does the Saudi Civil Transactions Law employ syntactic structure in forming legal sentences to achieve legislative precision and ensure the accuracy of legal meaning?From this central question, several sub-questions emerged:What syntactic features distinguish the legal sentence from other types of Arabic sentences? How do nominal and verbal sentences perform their functions in expressing civil rulings? What is the impact of using negation particles, conditional tools, conjunctions, and emphasis markers in constructing legal meaning? And how does the ordering of syntactic elements influence the precision and interpretation of legal provisions? The study aims to examine the syntactic structure in forming legal sentences within the Saudi Civil Transactions Law by analyzing the grammatical patterns used in civil statutory texts and assessing their consistency with classical Arabic grammatical rules in expressing legislative meaning. The research adopts the descriptive-analytical method, relying on the provisions of the Saudi Civil Transactions Law and comparing their syntactic constructions with those found in traditional Arabic grammar sources. The study consists of an introduction, conclusion, and five sections through which the researcher addressed the aforementioned questions. The findings reveal that the Saudi civil legal system intersects with Arabic grammatical rules in achieving legislative objectives. Nominal sentences contribute to establishing certainty and legal rights, whereas verbal sentences highlight obligation and legislative action. This underscores the role of syntactic structure as one of the most significant tools in contemporary legal drafting.
